Terms of Service

These terms govern your use of Standout Photos, a service operated by Velvary (Australia). By using the service you agree to them.

1. The service

Standout Photos uses AI to generate professional-style headshots from a photo you upload.

2. Eligibility

You must be at least 18 years old to use Standout Photos.

3. Your photo and acceptable use

You confirm that the photo you upload is of you, or of another adult who has given you permission to use it. You must not:

• upload a photo of anyone without their consent;
• upload images of minors;
• upload unlawful, intimate, sexual, or abusive content; or
• use the service to impersonate, deceive, or create misleading or harmful imagery of real people.

We screen uploads and may reject, refuse, or remove any image, and suspend accounts, at our discretion.

4. Rights in your photo and results

You keep ownership of the photo you upload. You grant us a limited licence to process it solely to create and deliver your headshots. You may use the headshots we deliver for your personal and professional purposes.

5. AI-generated content

Your results are generated by AI. They may contain imperfections or may not perfectly match your appearance, and are provided on an “as is” basis.

6. Payment

Prices are shown at checkout and are processed securely by Stripe.

7. Refunds

If we are unable to deliver your headshots, we will refund you in full. Because the headshots are a personalised digital product, we do not offer change-of-mind refunds once they have been delivered. Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot be excluded.

8. Availability

We may change, suspend, or discontinue any part of the service at any time.

9. Liability

To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid for the order in question. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including under the Australian Consumer Law.

10. Termination

We may suspend or terminate your access if you breach these terms or misuse the service.

11. Governing law

These terms are governed by the laws of Australia.
